Notice regarding the protection of personal data

Starting from May 25, 2018, the European Regulation 2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (“the Regulation”) applies. Its main purpose is to increase the level of protection of personal data and create a climate of trust that allows each person to control their own data. Thus, we inform you about the way to protect your personal data, what your rights are and how we adopt the provisions of the Regulation.

  1. Who are we?

Jobdistrict SRL is a limited liability company under Romanian law, with registered office in Galati, Brailei Street, no. 171A, 3rd floor, room 3, registered with the Galati Trade Register, with registration number J17/1141/2016, unique registration code RO36373795. Jobdistrict SRL is a personal data controller within the meaning of the Regulation.

This notification applies:

  • Our candidates and beneficiaries of our career counseling and guidance services;
  • Users of our website (https://jobdistrict.ro);
  • Representatives of our business partners, clients and suppliers.
  1. What personal data do we process?

The personal data we process are mainly your data that you provide to us when you send us your CV and other documents necessary for the recruitment procedure, as a result of a job vacancy or to register in our database in order to contact you when we have job offers corresponding to your professional profile and experience.

These data are:

  • identification data (name, surname, address),
  • contact data (email address, telephone number),
  • data regarding professional experience and education (names of employers, periods in which you worked, duties held within the company, name of the educational institution attended, period of studies, specialization);
  • data regarding qualifications, authorizations (accompanied by supporting documents) and skills held
  • level of knowledge of a foreign language other than the mother tongue;
  • personal identification number or other personal data with an identification function;
  • date and place of birth;
  • gender;
  • information regarding material benefits, in kind and of any other kind that you have had in previous employing companies, that you currently have and those that you want from your future employer;
  • citizenship and nationality;
  • references about your professional activity, personality, character obtained from former employers, as well as about the persons we may contact in order to obtain these references (the operator assumes that such a person has previously granted permission to be contacted)
  • bank account information (bank name, IBAN, Swift)
  • any other data contained in your CV that you provide regarding areas of interest in terms of your career and other data about your qualifications for employment.

Also, when required by law and based on the express consent provided by you, we may also process:

  • information about your disabilities and health status;
  • information regarding medical history, criminal convictions and other checks regarding your person.

In addition, we may also process information you provide us about other people we may contact in an emergency.

  1. Why do we process your personal data?

We process your personal data only for legitimate purposes, such as informing you about available and future job offers or to provide you with assistance in preparing a CV, a letter of intent, a thank you letter and to forward your CV, accompanied by the other documents necessary for the recruitment, placement and employment procedure, to the potential employer. The processing of personal data is carried out either through other third parties (specialized sites on this profile that contain databases with candidates such as: ejobs, best jobs), (social networking sites such as Facebook, LinkedIn, Instagram), applications (Whatsapp, Skype, Telegram), by applying directly on the Jobdistrict website https://jobdistrict.ro/ through the “Application Form”, or to any of the email addresses ending in jobdistrict.ro, as the case may be.

The processing of personal data is based on the following:

  • Compliance with legal obligation. As a recruitment and employment agency, Jobdistrict SRL is obliged to process the personal data of Romanian citizens residing in Romania or in another country of the European Union who are applying for jobs abroad (Law 156/2000 with subsequent amendments and updates, art. 7), or jobs in Romania (GEO no. 49/2009)
  • Execution of mediation contracts concluded with Jobdistrict SRL for employment purposes;
  • With your consent when you have provided us with the personal data mentioned in point 2 as a result of your desire to be registered in our database in order to consider you when we have job offers corresponding to your skills and experience. In order to fulfill this purpose, you will be contacted by email, SMS, telephone, express mail, fax and any social media application or site;
  • On our legitimate interest. As a recruitment and employment agency, Jobdistrict SRL has contracts concluded with its partners, for the performance of which it is necessary to process the personal data of the candidates, listed in point 2.
  1. Do we communicate personal data to other recipients?

In order to offer you the most competitive services, to execute the operation of applying for a desired job, to fulfill our legal obligations or for other legitimate purposes, we will transmit your personal data to our clients, legal entities that publish and are looking for employees. There is also the possibility of transmitting your data to the authorized state bodies, always ensuring that we establish adequate guarantees for the protection of your data (for example, standard contractual clauses, mandatory addresses, etc.).

All data transfers mentioned above are carried out in compliance by Jobdistrict with the principles related to the processing of personal data, in particular the principle of personal data minimization – Jobdistrict transmits to third parties only the personal data that is strictly necessary to achieve the aforementioned purposes.

  1. How long do we process personal data and how do we protect it?

Your personal data is processed throughout our contractual relationship, whether voluntary or involuntary, as well as as long as national legislation obliges us.

To ensure the confidentiality and appropriate security of personal data, we apply the following security measures:

  • adequate user authentication measures;
  • secure network infrastructure.

  1. Your rights

As the data subject, you can contact our data protection officer at any time and free of charge, with a notification, using the contact details mentioned above in point 6 in order to exercise your rights in accordance with the GDPR.

These rights are the following:

– The right to receive information regarding data processing and a copy of the processed data (right of access, Article 15 GDPR),

– The right to request the rectification of inaccurate data or the completion of incomplete data (right of access, art. 16 GDPR),

–      The right to request the deletion of personal data “the right to be forgotten” and, if the personal data have been made public, the transmission of information regarding the deletion request to other operators (right to erasure, Article 17 GDPR),

–      The right to request restriction of data processing (right to restriction of processing, Article 18 GDPR),

–      Right to data portability – you can receive, under certain conditions, the personal data you have provided to us, in a machine-readable format or you can request that the data be transmitted to another operator (right to data portability, Article 20 GDPR),

–      The right to object to data processing with the intention of ceasing processing (right to object, Article 21 GDPR),

– The right to withdraw consent at any time in order to stop data processing based on your consent. Withdrawal will not affect the lawfulness of processing based on consent given before withdrawal (right to withdraw consent, Article 7 GDPR).

–      The right to lodge a complaint with a supervisory authority if you consider that the processing of your data is in breach of the GDPR (right to lodge a complaint with a supervisory authority, Article 77 GDPR).

Due to possible changes in legislation, a change to these data protection notices may become necessary. In such a case, we will inform you of these changes. To the extent that the changes affect processing that is based on your consent, we will request your new consent.
