What is form A1?

The A1 form is an official document used in the European Union, which certifies the affiliation of a posted worker to the social security system of his country of origin. It is necessary to avoid paying social security contributions in two different states.

Who needs the A1 form?

Any Romanian employer who posts or makes Romanian personnel available to another EU member state must obtain the A1 form, regardless of the duration of the posting, the field of activity or the industry in which they operate.

When is form A1 required?

This document must be obtained before starting work in another EU country. Depending on the legislation of the host country, the form may also be requested for short periods of just 2-3 days.

How to obtain the A1 form?

The A1 form is issued exclusively by the National Public Pensions House in Bucharest. The employer must submit an official application and meet certain legal conditions.
Once registered, the application is valid for approximately 60 days, during which time it is processed by the competent authorities. The A1 form can be requested for a period of up to 2 years, and in certain situations it can be extended to 3 years.

What happens if you don't have the A1 form?

The consequences of not having this document vary from country to country. Depending on local legislation, fines can be as high as:

  • 10,000 euros in Austria and Luxembourg
  • 3,300 euros in France
In addition to financial penalties, there is also the risk that the employer will be required to pay social security contributions in both the home and host countries.
